At Pricefx, protecting the privacy of those who use our services and visit our website is a top priority.   1. General Information on Data Processing
  2. Pricefx protects your data consistent with this Privacy Policy and applicable law:

The security of Personal Data is a high priority for us, and we require the operators of our web pages to take the protection of your Personal Data very seriously.

We treat your Personal Data confidentially and in accordance with the applicable data protection laws and regulations as well as this Privacy Policy.

We would like to point out that data transmission on the Internet (for example, when communicating via e-mail) can present security gaps. While we take all appropriate and reasonable data protection measures, complete protection of data from access by third parties is not possible.

  1. Pricefx collects the following information (some of which constitutes your Personal Data):

Websites and Products. We observe and analyse how you use our websites, products, and services through processing of identifiers, geolocation data, and Internet or other electronic network activity information. Specifically, we use Google Analytics to analyse the use of our web pages, including information about your computer and about your visits of our web pages (including your IP address, geographical location, and browser type), and we observe how you use our websites, products, and services.

Marketing and Transactional. We store and use contact information that you provide us while registering with us and subscribing to our services, solutions, email notifications and/or newsletters (e.g., name, email, business address, job position and phone number).

Careers. If you submit a job application to Pricefx in our web page’s Careers section, Pricefx will process your Personal Data as further described in that section; this Privacy Policy does not further deal with this type of data processing activity.

  1. Pricefx does not collect:

Special Categories of Personal Data. We do not collect “special categories of” or “sensitive” personal data, including specifically any data that reveals your racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, or genetic data or biometric data or any data relating to your health, sex life, or sexual orientation.

Data from Minors. Pricefx’s web pages and other services are not intended for use by individuals under the age of 18. In the event any known processing occurs with respect to a minor, Pricefx will involve that minor’s parent or legal guardian as necessary under applicable law.

  1. Pricefx obtains your Personal Data from a few sources:

Direct Interaction. We collect Personal Data you provide us when using our web pages and other services, including submitting registration forms and making sales and other inquiries (e.g., registration for events, participation in surveys, subscribing to newsletters, and purchasing products and services).

Automated Interaction. We may collect Personal Data automatically in connection your use of our web pages, products, and services. For such collections we use various technologies, including cookies, through which we get certain information that your browser sends us (e.g., IP address, browser type, and language). For more information, please see the Cookie section below.

Third Parties and Publicly Available Data. We may collect Personal Data you made publicly available (e.g., in social media posts), and we may collect data obtained from third parties, including data aggregators or automated interaction tools on other websites.

  1. Pricefx may use your data for a few reasons:

Improving your Experience. We may use Personal Data to improve your browsing experience on our web pages (e.g., to make navigation through our web pages more comfortable for you).

Answering your Inquiries / Marketing. We may need to process your Personal Data if you are interested in our products and services and/or if you want to receive our newsletter and other marketing materials. For this purpose, we may share your Personal Data with our partners and other third parties that are involved in fulfilling your requirements. If you are a user of our services or a participant in our marketing outreach, we may contact you (directly or through third-party partners) with survey requests and/or other data collection research activities for conducting customer research. Your participation in these activities is optional. Where necessary, we will obtain prior express consent to marketing communications but will always give you a chance to opt out.

Support. We may process your Personal Data to provide you support during our business relationship. This includes notifications about product updates, training notices, non-marketing (commercial) communications, and responses to specific requests you make. For this purpose, we may share your Personal Data (usually limited to contact information such as name, surname, company e-mail address, and contact phone number) with our partners and consultants, if necessary to facilitate the support we provide to you.

Legal Claims. Your Personal Data may need to be processed in order for Pricefx to protect against claims raised against or by us after the end of our business relationship or to ensure we can cooperate with investigations relating to our compliance with legal obligations.

Providing Services. We may process your Personal Data to enable you to utilize our applications, including, for example, authenticating your access to our SaaS services. We may use Personal Data and any related data or information obtained through the applicable service (in the aggregated and pseudonymized form) to improve and enhance the service and for other development, diagnostic and corrective purposes in connection with the service and other Pricefx offerings.

Note that Pricefx does not sell your Personal Data to any third parties, including specifically as “sell” is defined under the CCPA.

  1. Pricefx processes your Personal Data under the following legal grounds:

Contract. Our processing related to provision of our products and services (including support and maintenance) is required to perform our contractual obligations. 

Legal Obligations. Our processing described above with respect to legal claims is required for us to fulfill our legal obligations.

Consent. From time to time, including when you request marketing information from us under point iv) above, we will process Personal Data based on your informed consent. You may withdraw your consent at any time.

Legitimate Interest. In addition to the reasons described above, we may from time to time process your personal data as required to achieve our legitimate interests. We necessarily limit the scope of personal data required for such processing and therefore do not consider this processing to adversely affect your rights or freedoms.

Your provision and our processing of your Personal Data is not a statutory requirement.

  1. Pricefx will process your Personal Data only so long as is necessary:

Contractual Performance. We process your Personal Data while the contract remains in force so that we are able to fulfill our contractual obligations. After the contract‘s expiration or termination, we generally keep Personal Data for 4 years to deal with any post-termination requirements or any post-termination claims that could arise.

Service. We process your Personal Data as long as needed for servicing you, i.e., as long as we have an active relationship with you (whether or not that relationship is governed by a written contract).

Marketing. We process your Personal Data for marketing purposes as long as you wish to receive marketing communications from us. If you withdraw your consent or otherwise opt out of this type of communication, we will stop processing your applicable Personal Data for this purpose.

Legal Obligations. We keep your Personal Data where we may need them to comply with applicable legal obligations, and/or if we reasonably believe they will be needed to defend, prosecute or make a legal claim. Your Personal Data will be kept, as applicable, until public authorities conclude an applicable investigation or until the end of the legal proceedings at issue.

  1. You have certain rights to affect Pricefx’s processing of your Personal Data:

We want you to understand what rights you have according to applicable data protection law (including the GDPR if you live in Europe or the CCPA if you live in California) and how you are able to exercise them. If you are an individual from whom Pricefx obtains Personal Data and processes them as a data controller, you are considered a “data subject,” and you may be entitled to the following rights:

  1. Right to Object: You have the right to object, on grounds relating to your particular situation, at any time to the processing of your Personal Data (as may be further described, if applicable, in Article 21 of the GDPR). Pricefx may be required to stop processing your Personal Data unless we demonstrate compelling legitimate grounds for continued processing and those grounds override your interests, rights, and freedoms or we need to continue processing to establish, exercise, or defend legal claims. If your Personal Data is processed for the purposes of engaging in direct advertising, you have the right to object at any time to the processing of your Personal Data for such advertising purposes.
  2. Right to Withdraw Consent: If our processing is based on your consent (as described in Section 6 above), you may withdraw that consent at any time, without affecting the lawfulness of our processing that occurred before that withdrawal.
  3. Right to Access: You have the right to ask us what Personal Data we collect and store about you and for related information.
  4. Right to Rectification: You have the right to correct your Personal Data if necessary.
  5. Right to Restrict Further Processing: You may have the right to restrict some of our processing activities. Please be aware that this right may be subject to certain conditions, including, if applicable, those set forth in Article 18 of the GDPR.
  6. Right to Erasure (a/k/a the Right to be Forgotten): You have the right to ask for removal of your Personal Data from our systems. Please be aware that we are allowed to keep your Personal Data for any period required under applicable law.
  7. Right to Have Others Informed: If you have asserted your right to rectification, erasure, or restriction, Pricefx will communicate this to each recipient to whom we’ve disclosed the Personal Data, unless this proves impossible or involves disproportionate effort.
  8. Right to Data Portability: You have the right to data portability, which means we will provide Personal Data to you or another controller in a commonly used, machine-readable format. We may deny data portability requests where our processing is not based on your consent or contractual performance.
  9. Right to Complain to a Supervisory Authority: If at any time you think that we have violated applicable data protection law, including the GDPR or the CCPA, you may lodge a complaint with your local data protection government body.
  10. Right to be Treated Fairly: You have the right not to be unlawfully discriminated against concerning the quality or price of our services based on your decision to exercise one of the rights described above.

Note that the rights above may be subject to certain terms or conditions under applicable law. Specifically, if you are a resident of California, Pricefx may be required to verify your identity when processing a request to exercise one of the rights above. We will communicate that process to you upon receipt of a request, but this is likely to include matching your name, email address, and other contact information to information we already have on file.

Where Pricefx acts as a data processor (including, specifically, where we process your personal data in relation to our products), data subjects who want to exercise their rights should contact the responsible data controller directly. If we receive any requests where we are not a controller, Pricefx will forward your request to the responsible data controller.

  1. Specific Data Processing Activities and Information
  2. Visits to our web pages and creation of log files

Our system automatically collects data and information from your computer every time you visit our web pages.  This data and information may include:

  • Information about the type of browser you are using;
  • Information about your operating system;
  • Information about your internet service provider;
  • Your IP address;
  • The date and time of your visit to our web pages;
  • Information about the website from which your system has reached our website; and
  • Information about the website which you access from our website.

The data which we collect on you is stored in our system’s log files. As a rule, these data are not stored with other Personal Data.

We may use IP addresses to monitor the regions from which visitors come to and navigate our web pages.

  1. Cookies 

Our web pages use so-called “cookies.” Cookies are small text files which are stored on your computer and which your browser saves. They do not damage your computer and do not contain viruses or other harmful code. Cookies serve to make our pages and certain of our services more user-friendly, more effective, and safer.

Most of the cookies we use are “session cookies.” They exist only during one session and are automatically deleted after your visit. They disappear from your computer when you close your browser or turn off your computer.

Other cookies remain on your device until you delete them. These cookies allow us to recognize your browser on your next visit. You can set your browser to inform you about setting cookies and to allow cookies only in individual cases, to exclude the acceptance of cookies for specific cases or in general, and/or to activate the automatic deletion of cookies when the browser is closed. The functionality of our web pages may be restricted when cookies are deactivated.

Pricefx may use local shared objects such as flash cookies and local storage to store your preferences or display content based upon what you view on our web pages to personalize your visit.

  1. Required cookies:
    These cookies enable you to navigate our web pages and use certain features, such as accessing secure areas of our web pages and using Pricefx services.

If you have chosen the option to identify yourself to Pricefx, we may use cookies containing encrypted information to allow Pricefx to identify you each time you log into our web pages in order to use our services.

  1. Performance cookies:
    These cookies collect information about usage of our web pages, including which parts of the website are visited most often and if there are any error messages received from certain parts of the web pages. These cookies do not collect information that individually identifies you as a visitor (i.e., that could constitute your Personal Data). All collected information is aggregated and anonymised. It is only used to improve how Pricefx’s web pages function and perform.

Pricefx may engage third parties to track and analyze usage and volume statistical information from individuals who visit our web pages. As noted above, these third parties will only have access to anonymized and/or aggregated data.

  1. Functionality cookies:
    Functionality cookies allow our web pages to remember information you have entered or your preferences (such as your language or your region) and provide enhanced and personalised features. These cookies also enable you to optimize your use of Pricefx’s services after logging in. These cookies can also be used to remember changes you have made to text size, fonts, and other parts of web pages that you can customize.
  2. Targeting or advertising cookies:
    Pricefx may engage third parties to track and analyze usage and volume statistical information from individuals who visit our web pages. Pricefx sometimes uses cookies delivered by third parties to track the performance of Pricefx’s advertisements. For example, these cookies remember which browsers have been used to visit our web pages. The information provided to third parties does not include Personal Data, but this information may be re-associated with Personal Data after Pricefx receives it.
  3. Managing cookies:
    Because required cookies are essential to operate our web pages and provide our services, there is no option to opt out of these cookies, other than by not using our web pages.

However, you can disable cookies for specific pages by using your browser settings.

  1. Google Analytics

Our web pages use Google Analytics, a web analytics service of Google. Google can be reached at Google Inc., 1600 Amphitheatre Parkway Mountain View, CA 94043, USA. Google Analytics uses “Cookies,” which are described in Section 10 above. These are text files which are stored on your computer to analyse the way you use our web pages. The information about the way you use our web pages created by the cookie is usually sent to and stored on a Google server in the USA. IP address anonymization is performed on the Pricefx web pages so that your IP address is truncated beforehand by Google within Member States of the European Union or in other countries which are parties to the European Economic Area agreement. Only in exceptional cases is the full IP address sent to and only then truncated on a Google server in the USA. Google uses this information on behalf of the web pages‘ operator to evaluate the way you use our web pages, to collate reports on web pages activities and to provide Pricefx with other services related to web pages and Internet use. The IP address sent by your browser as part of Google Analytics is not combined with other data held by Google.

You can change your browser settings to prevent cookies from being stored; however, you should realise that, in these circumstances, you may find that you are unable to make full use of functions on the web pages.   1. Contact form

You can contact us by electronic means using the contact form on our web pages. If you wish to contact us in this way, the data which you enter will be sent to us and stored. This applies to the following data in particular:

  • Your full name;
  • Your email address;
  • as well as Any data you may enter in the form.

We only process the Personal Data you provide to deal with your request. The following data are also stored at the time you send your message:

  • Your IP address;
  • The date and time at which you submitted your request.
  1. Registration form

To use Pricefx services, you must register using a form provided directly on our web pages. When you register you will be required to provide certain mandatory data in addition to voluntary information; these types of data are identified separately but include limited pieces of Personal Data.

We process your Personal Data in this step in order to be able to provide you with our products and services (as required under our contracts with customers).

  1. Newsletter

You may have the option to subscribe to one or more free newsletters.  These newsletters, sent via email, provide you with the latest news in connection with our full suite price management and software solution and related resources and information. In addition, we may ask you if you would like to participate in Pricefx surveys. The data which you enter when subscribing to the newsletter are transmitted to us.

We need your email address in order to send you the newsletter.

You can cancel any newsletter subscription at any time by withdrawing your consent with future effect. There is a link in every newsletter sent to you which you can click to automatically unsubscribe. Alternatively, you can send an email to dp@pricefx.com or a letter to us at one of the addresses identified above.

  2. Facebook plugins (Like Button)
    Plugins from the social network Facebook, provided by Facebook Inc., 1 Hacker Way, Menlo Park, California 94025, USA (“Facebook“), are integrated into some of our web pages. You can recognize Facebook plugins by the Facebook logo or the Like Button on our web pages. An overview of the Facebook plugins can be found here: http://developers.facebook.com/docs/plugins/

When you visit our web pages, the plugin creates a direct connection between your browser and the Facebook server. Facebook will be informed that you have visited our web pages with your IP address. If you click the Facebook Like Button while you are logged in to your Facebook account, you can link the content of our web pages to your Facebook profile. This allows Facebook to associate the visit of our web pages with your user account. We would like to point out that as a provider of our web pages we do not receive any knowledge of the content of the transmitted data as well as their use by Facebook. By using Twitter and the “retweet” function, our web pages you visit will be linked to your Twitter account and shared with other users. During this process, information is also transmitted to Twitter. Please note that we as the content provider of these web pages do not have knowledge of the information contained in the data transferred or of its usage on the part of Twitter.     We have integrated the “recommend button” of LinkedIn Corporation (“LinkedIn“) on some of our web pages. LinkedIn is operated by LinkedIn Corporation, 2029 Stierlin Court, Mountain View, CA 94043, USA. The button is recognisable by the LinkedIn logo. Every time one of our web pages containing LinkedIn functions is viewed, a connection to LinkedIn servers will be established. LinkedIn will be notified that you have visited our web pages with your IP address. If you click the LinkedIn “recommend” button, while being logged in to your LinkedIn account, LinkedIn will be able to assign your visit to our web pages to your user account. Please note that we as the provider of these web pages have no knowledge of the content of transferred data or LinkedIn’s usage of them.   1. XING
    These web pagse use the social plug-ins for the social network xing.com, which is operated by XING AG (“Xing“), Gaensemarkt 43, 20354 Hamburg, Germany. This button is recognisable as the grey “x” on a green background.

When a user visits the web pages which contains such a button, the user’s browser establishes a direct connection to the Xing servers. The content of the “x” button is transmitted by Xing directly to the user’s browser and then to the web pages. The provider no longer has any influence on the extent of the data collected by Xing via the button.

When the plug-in is integrated, Xing receives the information that you have visited the relevant web pages. If you are logged in to Xing, Xing can assign the visit to your Xing account. The purpose and scope of data collection and further processing and use of the data by Xing as well as your rights and settings options for the protection of your privacy are detailed in the Xing data privacy policy at https://www.xing.com/privacy

  1. YouTube
    Our web pages use plugins from Google’s YouTube site. The site is operated byYouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA (“YouTube“). If you visit one of our YouTube-enabled web pages, you will be connected to YouTube’s servers. The YouTube server is informed which of our web pages you have visited. When you are logged in to your YouTube account, you enable YouTube to directly map your surfing behaviour to your personal profile. You can prevent this by logging out of your YouTube account. You can prevent this association being made by logging out of your YouTube account before visiting our web pages. YouTube also processes your Personal Data in the USA and is subject to the EU-US Privacy Shield for this purpose: https://www.privacyshield.gov/EU-US-Framework

  1. Disclosure of data to third parties

As a rule, we will only pass your Personal Data in compliance with applicable data protection laws to service providers, business partners, and other third parties who need it in connection with our business relationship with them.

We may disclose Personal Data to service providers working on our behalf, including services that enable us to provide our products and services. In this context we comply with application data protection regulations, including, where applicable, binding these data processors by our instructions and other contractual limitations and obligations concerning the processing of Personal Data.

We may disclose Personal Data to other third parties if we are required to do so by law or in legal proceedings or in order to supply and manage our products and services.

We may process your data (solely in the aggregated and pseudonymized form) in connection with our business, benchmarking activities and services.

We may disclose Personal Data (in all categories) if Pricefx is purchased by a third party (regardless of the form of that purchase or whether it applies to all or only a portion of Pricefx). This may include disclosure prior to the consummation of the purchase (i.e., during “due diligence”). Regardless of who obtains Personal Data so disclosed, they will need to keep using it in accordance with this Privacy Policy unless they tell you otherwise. Note specifically that this does not constitute a “sale” of your Personal Data under the CCPA.

  1. Security standards

Pricefx has implemented appropriate physical, technical, and administrative security standards to protect Personal Data against loss, misuse, modification or destruction. These web pages use SSL encryption for security reasons and for the protection of the transmission of confidential content, such as the inquiries you send to us as the web pages‘ operator. An encrypted connection is indicated by the browser’s address line  changing from “http: //” to “https: //” and the lock icon appearing in your browser line.

If SSL encryption is activated, the data you transfer to us cannot be read by third parties.

  1. Changes to this policy 

We may update this Privacy Policy from time to time. We therefore recommend that you check in on, and read, this Privacy Policy regularly to ensure that you are familiar with our data protection practices. This Privacy Policy was last updated on May 2nd, 2023.
